In our republican democratic system, the purpose of the Constitution is to protect the citizens from the abuses of the representatives.

   

And in this context, it seems normal that a counter-power can control that this supreme foundation is well respected. However, our Fifth Republic is designed in such a way that the reality is very far from this ideal.

We talk very little about them, but the pension reform initiated by Emmanuel Macron has put them back in the spotlight. And once again, the “Sages”, as they are called very curiously, only defended the government in place.

A composition that raises questions

Of course, we could largely dwell on the fact that our current Constitution was not written by the people and that it was validated by an electorate, most of whose components are now deceased. By this, we could probably already question its legitimacy.

But we can also be offended by the way in which the body supposed to ensure respect for the foundation of our Fifth Republic was built: the Constitutional Council. You should first know that its nine members are appointed by the Presidents of the Republic, the National Assembly and the Senate for a period of nine years. Every three years, one third of the Board is renewed. Nicolas Sarkozy and François Hollande, as former heads of state, would likewise have the right to sit there, but do not.

However, those who choose the "wise" are also those who make the law.

However, it seems absurd that individuals with the capacity to create unconstitutional rules are also those who appoint the people responsible for verifying the validity of their proposals. It's a bit like a sports team designating the referee for a match.
